31 July Pool Closure Notice

Dear community members,

The community effort to open the pool was reliant on each owner reviewing and agreeing to the terms of the COVID-19 Policy. All were notified and advised that if these requirements were not followed the pool could be closed for a few days or for the remainder of the season. We appreciate the many who have embraced the policy and are enjoying the pool responsibly. However, there have been issues with some owners or their families using the facility and not abiding by these rules. We want owners to be able to enjoy and use the pool during these difficult times, however that means that following the required guidelines to protect your family and others is vital. The last week owners have chosen to disregard the county and community requirements for safe use. Multiple requirements have been disregarded, use of pool furniture, minors without adult supervision, opening the gates for others, jumping the fence, bringing guests, not adhering to the pool hours of operation, etc. Due to the continued disregard, the pool will be closed for the next 7 days. Each owner who has a active key fob agreed to abide by the COVID-19 policy and restrictions. The pool cannot be open as the Certified Pool Operator, management and the board cannot monitor 24/7 and ensure that these requirements are followed. After this 7 day closure, if those who choose to use the pool cannot abide by the rules the pool will be required to close for the season.

Our legal counsel advised us that this policy is necessary given our duties and we have carefully reviewed the recommendations set forth by the State of Utah and Davis County.

During this time due to limited access and use “Guests” are not allowed. Due to restrictions the fitness centers and common areas of the clubhouses will not be open. Owners will have access to the restrooms but all other areas of the interior of the clubhouse will be closed off. Owners are asked to respect and refrain from entering the other areas of the clubhouse. The intention will be to open those areas as the state moves to a more manageable state (green) level.

As a reminder, the established rules already in place for pool usage require children under 14 to be accompanied by an adult. Additionally, swim diapers must be used for all children who are not toilet trained.

The policy is also available on the Foxboro North HOA Website foxboronorth.com (owners who do not respond with the attached signed agreement will not have access to the pool/s).

Clarifications and guidelines due to COVID-19 and cleanliness issues:

  • Pool hours will operate at reduced hours from 6:00 am to 9:00 pm. 

  • Pools will operate at the current state gathering requirement which is 50 people or less. If you arrive and the pool is at capacity, you will need to leave and return at a later time. To be considerate of others, please limit pool time to two hours or less and consider visiting during off peak times so all can enjoy time at the pool.

  • HOA owned pool furniture, tables, and chairs are not to be used.

  • As members of the HOA and as the “owners” of the pools, each family is charged with monitoring our own families to ensure that no one comes to the pool if they are sick, have any COVID-19 symptoms, or have come into contact with anyone that has been diagnosed with COVID-19 in the last 14 days. Each family is also to ensure that they are following the recommended social distancing rules both in the pool and on the pool deck.

  • No guests will be allowed.

  • Please bring sanitizing wipes and hand sanitizer to use to wipe down surfaces before and after your personal use.

  • Parents should regularly take your children to use the bathroom. It is also recommended that parents accompany children in the bathrooms at all times.

  • Swim diapers – All children who are not toilet-trained must wear a swimming-approved diaper with rubber pants over the diaper. For your convenience, a dispenser with diapers and covers is provided at each facility for a nominal cost. Swim diapers and covers are recommended for all children age 3 and under. The cleanliness and safety of the pool is best maintained when incidents are reported immediately. When pool rules are being followed and a poop incident occurs, if it is immediately reported, no fees will be assessed. If rules are not being followed or if it is not immediately reported, the adult homeowner will be responsible for the costs associated with closing and cleaning the pool area.

  • Food and drink are only permitted under the pavilion. As pool furniture is not to be used at this time, it is recommended that food is not to be brought to or consumed at the pool.

  • Key fobs are not to be shared or passed around to anyone outside of your household. Gates and doors should not be opened for those without key fobs. You are responsible for everyone that you allow to enter.

  • All pools will be accessed via the pool gates and not the clubhouse entrance.

Please discuss these rules with youth over 14 and young adults in your home who may be using the pool independent of the homeowner. If the Foxboro North HOA Pool Rules or the additional guidelines found in the Pool Policy Relating to COVID-19 are not followed, it will be necessary to close the facilities. Together we can work together to keep them open. Changes in state and county policies, as well as sustained increases in COVID-19 transmission rates, may also result in closure of the facilities.

Pool policy meeting notice

An open pool meeting about the COVID-19 policy will be held on July 6 at 7:00 p.m. via Zoom. Please see the meeting link in the email sent to your household today. If you did not receive an intive, please contact RedRocK HOA Mangement at info@redrockhoa.com.

If you opt in to using the pool in July, we appreciate your reading and discussing all the pool guidelines and rules with all members of their households before signing.

Please note:

  1. The pools are not yet open, but the hope is to be able to open them on July 6, 2020 at 6:00 a.m. As mentioned previously, the fitness facilities will remain closed as will the other areas of the clubhouses. Only the restrooms will be open for use.

  2. The documents can be signed and sent back electronically via attached photos or a scan.

  3. Those who return the signed policy prior to the pool opening will have their key or mobile app activated.

Update on provisional pool opening, annual meeting

Dear residents,

We hope that your family is healthy and enjoying the summer despite the limitations of the pandemic.

Several people have reached out to Dixie regarding the gym/clubhouse/pool, and we would like to communicate the status to all of the residents as well.  

At the very onset of the pandemic shut-down, expecting that it would not be a prolonged shut-down, the board decided to accelerate some planned maintenance and improvements to the large clubhouse on Amberly to take advantage of the time and avoid having to close the clubhouse again to facilitate that work.  We are pleased to announce that those maintenance items and improvements are complete.  We are very anxious for the residents to be able to see and enjoy them.  These improvements include enlargement of the gym space by reclaiming an adjacent storage room (we moved the tables/chairs stored in it to the empty office next to the entrance), painting of the entire interior of the clubhouse, replacement of the entry tile & childrens' room flooring, replacement of some of the great room lighting, replacement of the gym blinds, relocation of the childrens' room entrance from the great room to the gym, and acquisition of some new gym equipment.  Some of the older but still functional commercial-grade gym equipment in the large clubhouse will be moved to the small clubhouse, which had been stocked by the developer (Woodside) with a lesser grade of equipment.  

The gym is an interior space and is therefore higher risk for fostering disease transmission.  The current health department guidelines allow for facilities such as this to open provided that we are able to meet certain criteria, which include increased cleaning and limiting occupancy to facilitate social distancing.  Given that the gym is unstaffed, we do not have the ability to meet those criteria unless we hire someone to be there during all hours of operation.  This would of course significantly increase operating costs.  Opening without the recommended safeguards in place — particularly given the higher risk of interior spaces and the high-touch environment of the gym — is not a risk the board feels that it is wise based upon the advice of our legal counsel.  

Several residents have questioned whether HOA fees would be reduced or rebated due to the inability to use the amenities.  The vast majority of our expenses are fixed costs unimpacted by the shutdown such as landscaping maintenance costs, utilities, building upkeep, and management fees.  Unfortunately even pool-related costs are not eliminated during this time because if we want to open the pool at all this season we still have to maintain it regardless of whether people are actually swimming in it yet.  The only ongoing expenses that are reduced due to the pandemic are interior space cleaning and supplies while the clubhouse is completely closed, and that is not a significant cost.  In fact, as we open the pool, our cleaning costs may be increased due to the need to have daily cleaning of the bathrooms, which must be accessible if the pool is open.  Therefore, fees remain the same and cannot be rebated.  We appreciate everyone's patience and understanding. It's a frustrating situation for all of us, and we're constantly looking for ways to get the most value possible out of our fees even as we navigate the pandemic.

Last week we sent out a communication regarding the tentative opening of the pool on July 6.  We know that many families are anxious to enjoy the pool, and we are anxious to open.  We are monitoring the Davis County Health Department and State of Utah communications and we are basing our decisions on the guidance we receive, particularly given the current significant uptick in Davis County cases, noting that North Salt Lake has the largest number of cases in the county.  Please monitor our brand NEW HOA website for the latest status of opening:  www.foxboronorth.com  (Please note that we will be decommissioning the Facebook page and will be posting all updates on the website.)

Lastly, due to social distancing requirements, we had to postpone the annual meeting typically held in April.  We are hoping to take advantage of the warm weather and pavilions at Legacy Park — which should allow for the necessary social distancing — and have the annual meeting in early August provided there are no pandemic-related restrictions placed on us by the county or state in the meantime.  There will be 3 board seats open, and if you have a desire to serve on the board, please consider running.  If you have questions about what that would entail, please reach out to any of the current board members and we would be happy to give you an idea of the time commitment involved.  Stay tuned for an announcement of the exact date!

Provisional Opening of Pools Planned

After receiving several inquiries from eager homeowners, and after careful consideration, we have decided to test a provisional opening of the pools starting Wednesday, July 6, 2020. Given the current global pandemic of COVID-19, we are opening under certain conditions. It is important to note that even this provisional opening is subject to change pending developments over the next 15 days. Please see the attached document containing Foxboro North Pool Use Policy. Our legal counsel advised us that this policy is necessary given our duties and we have carefully reviewed the recommendations set forth by the State of Utah and Davis County.

Please read the entire document. The parent or guardian in the household should sign the waiver if anyone in the household will use the pool during our current 'yellow' risk phase. If there are other people living in the home who are residents but not related (e.g. a roommate), a waiver for that individual is required as well. Those individuals should not use the pools/clubhouses until they have returned the waiver. Please sign, initial, and send back an electronic copy of the last page of the attached document (scan or picture) to RedRock HOA Management and your fob will be enabled when the pool opens. Owners who do not respond with the attached signed agreement will not have access to the pool/s. When management receives the signed proxy your access will be updated to begin on July 6, 2020. You can scan and email or mail the document.

For the board to adopt an official policy, we must abide by certain state requirements. At least 15 days from receipt of this notice, or July 4, 2020, or as our schedules allow soon thereafter (the date and time will be communicated to you as soon as it is set), the board will host an open meeting via Zoom to discuss this document with members, answer and respond to questions, and a motion will be made at that time to formally adopt this policy. The policy will then become legal and binding 15 days from that date. The board has elected to proceed provisionally under this policy forthwith subject to your agreement (exhibit "A"). If you have concerns regarding this policy, please send them to the Board immediately (foxboronorthhoa@gmail.com) and refrain from using the pool until we sort them out during our open meeting. As is the case normally, all who choose to use our pool prior to that time will accept the risks associated with doing so. The Board will act as if all required measures have been adopted per this policy throughout this time period.

May 2020 Community Update

Greetings, neighbors,

We hope this update finds you all doing well. The biggest question we've been hearing lately is: When will we be opening the clubhouses, gyms, and pool areas.

We are following the Utah Leads Together Phased Guidelines for the General Public & Businesses plan to keep the community safe and protected to the best of our ability. Under the current guidelines from Governor Herbert, Davis County is now in the "Yellow" low risk phase. This means that most businesses are able to be open and operate as long as a number of guidelines are followed. These include a number of social distancing, occupancy limit, sanitation practices, and symptom monitoring rules that must be followed in order to open our clubhouses, gyms, and pool areas.

The Foxboro North HOA board of directors has decided that our clubhouses, gyms, and pool areas will not be opened until Davis County enters the "Green" risk phase, as we are not staffed or equipped to allow implementation of the guidelines currently required (symptom monitoring including temperature screening of every user, enforcement of occupancy limits, enforcement of social distancing while using the equipment or pool, and strict sanitation of all equipment and heavy touch areas before and after each use). We appreciate your patience and understanding as the board continues to protect the interest of the community as a whole. We are in the process of preparing the pools for use, including inspection by the Davis Country Department of Health, so we will be ready to open when we enter the Green phase.

Parks and playgrounds are open, but the health department still advises observance of social distancing for their use.

We also want to inform the owners that our renovations of the Amberly Clubhouse are nearly complete, so when we are able to open, you will benefit from:

  • Expanded gym area (tables and chairs have been relocated for more convenient access in the front office area)

  • Updated children's room entrance (children's room has also had the toys removed for safety reasons. We are also adding Netflix and Disney+ subscriptions for the children's room)

  • New paint throughout throughout the clubhouse

  • Updated entrance flooring, and light fixtures in the great room

We are excited to announce that our community website, foxboronorth.com is now live! Feel free to have a look around. We welcome any feedback you might have for the website. Our intention is to use this website for communication of information to owners, and serve as a resource for the answers frequently asked questions, and common processes. There are also various forms available there, such as the "Design Review" form required any time owners want to update the exterior of the home or landscaping.

Speaking of landscaping, we'd also like to issue a reminder that while the board is understanding of the current pandemic conditions, and have tried to take a sympathetic approach to rule enforcement, we are seeing more violations of basic rules such as yard maintenance, parking of trailers and rvs, and landscaping changes without approval of the board. This is a gentle reminder that yards must be maintained regularly, with grass mowed, weeds pulled; trailers are allowed to be parked in front of your house (either in the street or your driveway) generally for the loading and unloading for a camping trip, but may not be stored there for extended time periods; and any proposed change to the exterior of your home, including, but not limited to, expanded concrete areas, sheds, gazebos, changes to fencing, paint color changes to the home, etc., must be submitted to the board for approval, and ultimately approved before proceeding with the project. Answers to any questions you might have about these and other rules can be found on our website.

Finally, we are overdue for our Annual Meeting, which was scheduled for early April. In order to have our general election we are required to have a minimum number of owners in attendance. Due to Covid-19 restrictions, we cannot congregate in those numbers. We will continue to keep the owners informed as additional information unfolds, and the date of the Annual meeting will be announced. Our monthly board meetings are similarly on hold. The board has continued to run the business of the HOA via email and phone calls, but we look forward to being able to meet again and will continue to welcome your participation as members of the HOA in those meetings.
